State-By-State: Legal Overview, Market Data and Outlook | Chapter 2 MJBIZDAILY.COM Qualifying medical conditions Cancer, epilepsy, glaucoma, HIV/AIDS, intractable migraines unresponsive to other treatments, terminal illness, a chronic medical condition that causes severe persistent pain or persistent muscle spasms including but not limited to multiple sclerosis, seizures, Parkinson’s disease and Tourette syndrome, debilitating psychiatric disorders including but not limited to PTSD, a chronic medical condition that is normally treated with a prescription medication that could lead to physical or psychological dependence if a physician determines that MMJ could be effective in treating the condition and serve as a safer alternative and in the professional judgment of a physician, any other chronic, debilitating or other medical condition including but not limited to hepatitis C, ALS, inflammatory bowel disease, Crohn’s disease, Huntington’s disease, autism, neuropathies, sickle cell anemia, agitation of Alzheimer’s, cachexia and wasting syndrome Business regulations Missouri’s Department of Health & Senior Services enacted emergency rules in June 2019 that govern multiple aspects including testing, dispensing, seed- to-sale tracking, transportation and taxation. Although the state has capped the maximum number of business licenses issued, it has stated it will increase caps to meet demand if necessary. The list of qualifying conditions is fairly extensive and allows physicians to have some leverage in certifying an off-list qualifying condition. Additionally, two independent physicians may certify that a patient is allowed to possess greater than state maximum possession amounts if deemed medically necessary. Application and licensing fees are moderate.
