State-By-State: Legal Overview, Market Data and Outlook | Chapter 2 MJBIZDAILY.COM Qualifying medical conditions ALS, anxiety, chronic pain related to musculoskeletal disorders, chronic pain of visceral origin, migraines, multiple sclerosis, opioid use disorder (patient must be undergoing medication-assisted therapy), terminal cancer, muscular dystrophy, IBS (including Crohn’s disease), Tourette Syndrome and terminal illness. When conventional therapy is not effective, the following conditions apply: seizure disorder/epilepsy, intractable skeletal muscular spasticity, glaucoma or PTSD. The following conditions apply if severe or chronic pain, severe nausea or vomiting, cachexia or wasting syndrome results from the following condition or treatment thereof: positive status for HIV, AIDS and cancer. Business regulations Very heavy. Previously, only 12 vertically integrated dispensaries were allowed under state law, though Gov. Phil Murphy recently signed into law a medical marijuana expansion bill that will allow for stand-alone licenses. Dispensaries undergo an intensive application and registration process and are subject to numerous regulations, including those covering recordkeeping, cultivation limits, security and hours of operation. The limits on allowable forms of marijuana are some of the most restrictive in the country, and the requirement that all products contain no more than 10% THC is considered overly restrictive and onerous.
