State-By-State: Legal Overview, Market Data and Outlook | Chapter 2 MJBIZDAILY.COM Qualifying medical conditions HIV/AIDS, Alzheimer’s, ALS, cancer, cachexia/wasting disorder, persistent nausea except that related to pregnancy or cannabis-induced cyclical vomiting syndrome or cannabinoid hyperemesis syndrome, Crohn’s disease or ulcerative colitis, epilepsy or debilitating seizures, multiple sclerosis or persistent and debilitating muscle spasms, PTSD, autism, terminal illness, hospice care, a rare condition or disease affecting less than 200,000 individuals in the U.S. that is not adequately managed by conventional medications other than opioids or opiates or physical interventions, pain lasting longer than two weeks that is not adequately managed by conventional medications other than opioids or opiates or physcial interventions and any condition that the compassionate use board approves on an individual, case-by-case basis. Business regulations Heavy. Although final rules are still in development, the text of House Bill 3001 sets forth rules governing all aspects of business operations including security, storage, transportation, processing, packaging and advertising. Although the list of qualifying medical conditions is extensive, Utah has issued tight regulations on the forms of medical marijuana sold―including packaging flower in individual blister packs that are not to be opened until directly before use. Physicians, pharmacists, advanced nurse practioners and physician’s assistants may have limited affiliation with cannabis production establishments. Application and license fees are still being determine by the Utah Department of Health and Utah Department of Food and Agriculture and are expected to be released some time after the state legislative session ends in May 2019.
