You should not have to spend time and money teaching your arbitrator or mediator how our industry works, especially considering the substantial costs associated with legacy alternative dispute resolution (“ADR”) providers. Yet in our experience, many neutrals have neither a basic grasp of the fundamentals nor much of an interest in learning.

We created arb420 to directly address this problem. Our roster brings together some of the most experienced cannabis attorneys in the world. Our neutrals understand the products, the process, our industry’s culture, its commercial workings and history, and its regulatory realities. Each neutral brings that knowledge to bear to help resolve disputes involving cannabis businesses, their owners, investors and commercial counterparties.

arb420’a founders are Matt Goldberg and Andrew DeWeese, longtime cannabis industry attorneys with decades of litigation, arbitration and mediation experience. “arb420 brings together arbitrators and mediators who truly understand the cannabis business, and provides access to a streamlined, affordable platform for dispute resolution within the industry,” says Goldberg. “arb420’s mission is to solve the two biggest problems resolving cannabis business disputes with courts and old-guard ADR services—a fundamental lack of industry knowledge and a protracted, expensive process.”

“I am sick and tired of seeing clients treated like second class citizens by decisionmakers who harbor prejudice toward people in the cannabis industry,” says DeWeese. “For years, Matt and I dreamed of creating a platform for dispute resolution where cannabis litigants are treated with respect, and now it’s finally a reality.”

arb420’s proprietary rules and procedures are designed to curb unnecessary delay and expense while giving each side a fair opportunity to present their case. Filing and administration are electronic. Hearings, mediation sessions and conferences take place remotely, eliminating the cumbersome travel that can make an already expensive disagreement even more costly. Rules, fees and neutral profiles are available arb420.com, so businesses and counsel can fully assess the unique value proposition arb420 brings to the table.

Mediation gives the parties room to negotiate a result that addresses what they need from the business relationship: getting paid, keeping a supply arrangement intact or finding a workable exit. When settlement is out of reach and a binding decision is needed, arb420 offers arbitration before an independent arbitrator with expertise in cannabis business law.

Agree on arb420. Disagree on everything else.

The best time to decide how to resolve a business dispute is before one arises. arb420’s model clauses allow businesses to designate arb420 as the contractually agreed arbitration or mediation service when they negotiate their contracts.

If a proceeding is already underway elsewhere, arb420’s transfer agreement gives the parties a way to agree to move that dispute to arb420. Parties can disagree about what happened, who owes what, how a business relationship should play out, and literally everything else, and can still agree they want arb420 to administer their dispute. Parties with existing arbitration or mediation agreements in place, or court orders enforcing those agreements, can easily conduct those proceedings through arb420.
